By signing this consent form the parent/other legal representative of the child or an authorised full-aged (adult) person accompanying the child and acting on behalf of the parents/other legal representatives of the child represents that s/he • Has read and familiarised himself/herself with the Rules of the CurioCity Edutainment Centre for Children (hereinafter – Edutainment Centre) (hereinafter – Rules), understands the Rules, and agrees to obey them; has familiarised the accompanied minor indicated in this Consent (hereinafter – Child) with the Rules and allows the Child to visit the Edutainment Centre on his own or together with the Child’s parents/another legal representatives of the child or an authorised full-aged person accompanying the Child and authorised by parents (legal representatives) of the Child (hereinafter – the person responsible for the Child). • Undertakes to duly obey the Rules and to ensure that the Child will obey them, and also takes full responsibility for the Child and for any risk related with the compliance with the Rules and any damage that may arise; is aware that the Rules are publicly available at the Edutainment Centre and on the website of the Edutainment Centre at www.curiocity.lt, and have also been provided together with this Consent as an inseparable part of the Consent. • Agrees that should the Child fail to obey the Rules, the person responsible for the Child who has allowed the Child to visit the Edutainment Centre shall take full responsibility for it and understands that UAB Educatus, reg. No. 304496988, (hereinafter – Operator) shall not be liable for any damage arising from failure to comply or failure to comply properly with the INFORMATION ABOUT PROCESSING OF PERSONAL DATA OF A PRIVATE INDIVIDUAL 1. Personal data of a private individual is collected and processed for the purposes of visiting the Edutainment Centre on the basis of the conclusion and implementation of the contract, and also for direct marketing purposes on the basis of the consent of the private individual. 4. A private individual has the following rights: the right to access his personal data which is processed, the right to contact Us with a request to correct inaccurate personal data, the right to obtain or transfer his personal data to another company – the so-called right to data portability (this right applies when personal data is processed automatically, based on the private individual’s consent or upon signing an agreement), the right to contact Us with a request to delete his own personal data where there is a legal basis in legal acts for it, the right to contact us with a request to restrict processing of the data where there is a legal basis in legal acts for it, the right to disagree with the processing of data where the data is processed on the basis of a legitimate interest and where there is a legal basis in legal acts for it; the right to withdraw at any time his consent to process personal data, without prejudice to the lawfulness of the consent for processing of the data given prior to the withdrawal of the consent. A private individual wishing to exercise his rights hereunder may contact the Edutainment Centre at Islandijos pl. 32, Kaunas, or by e-mail: info@educatus.lt. 5. We may provide the personal data processed by Us to law enforcement, judicial or pre-trial investigation authorities for any investigation they may be carrying out or in other cases provided for by law without the separate consent of the private individual. 6. We also use the services of third parties (e.g. web site design or administration services, third party servers, accounting services) that may require access to the personal data of private individuals processed by us to provide the services properly. In this case we ensure that the data processors would observe the duty of confidentiality and proper protection of personal data. 7. We store the personal data submitted for the purposes of visiting the Edutainment Centre and the personal data submitted for direct marketing purposes for 3 (three) years after the expiration of the Consent. After 2 (two) years from the date of the Consent to process personal data for direct marketing purposes, we send a notification to the private individual with a proposal to renew the consent. If the private individual does not renew his consent within 1 month, we discontinue sending newsletters and offers and, after the expiry of the remaining term of the Consent, destroy the personal data of the private individual stored by, unless the data is stored on another basis specified in the Data Controller’s Privacy Policy or in legal acts. If a private individual renews the consent to process his personal data for the purposes of direct marketing, the term for storing the person’s personal data is extended for another three years (sending direct marketing messages is discontinued after 2 years and the Consent is stored for 1 year for any disputes or claims), unless the data is stored on another basis specified in the Data Controller’s Privacy Policy or in legal acts. 8. A private individual may at any time withdraw his consent to process his personal data for the purposes of direct marketing by clicking on the link ‘Decline subscription of newsletters’ or by replying STOP to the next SMS message. A private individual may also withdraw the consent to process his personal data for direct marketing by contacting the Edutainment Centre at Islandijos pl. 32, Kaunas or by email to info@educatus.lt. Processing of personal data for direct marketing will be stopped immediately. 9. If you think that processing of your personal data by Us does not comply with the applicable law, you may contact the State Data Protection Inspectorate (www.ada.lt). CONSENT Rules, reckless and/or dangerous behaviour of the Child or for compensation of any such damage. • Has duly considered the services provided by the Edutainment Centre, its equipment, environment, his/her and the Child’s abilities and capabilities to visit the Edutainment Centre and understands that the Edutainment Centre offers activities, forms of entertainment, and inventory for children in the age range of 1 to 13 years, and ensures that the Child will use activities, forms of entertainment, and inventory of the Edutainment Centre properly and according to the age of the Child. • Agrees in good faith and without any compulsion – assuming the risk and liability associated with the damage that may be incurred by the Child, and/or the Edutainment Centre, and the third parties – to allow the Child indicated below to be admitted to the Edutainment Centre on his own without supervision of the person responsible for the Child and understands that the Edutainment Centre provides only the services of organising children’s leisure, but not the services of child care or education and that the Operator is not responsible for the supervision of the Child and any damage arising thereof. If the person responsible for the Child who signs this Consent visits the Edutainment Centre together with the Child, s/he shall take all responsibility thereof, and agrees to monitor the Child regularly, continuously, at his/her own risk and liability, and to take care and supervise the Child, his behaviour and health. • The Child who is allowed to visit the Edutainment Centre by the person responsible for the Child must not have any health or other issues which may have any negative effect on the Child and/or the third parties in the Edutainment Centre. GENERAL Unless the context requires otherwise, the words used in the Rules in the singular include the plural and vice versa. Administrators, activity coordinators, event hosts, and other employees of the Edutainment Centre; CURIOCITY – a City for Curious Children, a 1,500 sqm educational and entertainment centre for children aged 1 to 13, located at the MEGA Shopping and Entertainment Centre at Islandijos pl. 32, Kaunas; Each person present at the Edutainment Centre who is visiting the Edutainment Centre in accordance with the procedure specified by the Operator; UAB Educatus, address Islandijos pl. 32, Kaunas, Reg. No. 304496988, VAT reg. No. LT100010845614; Services of organising activities and leisure for children aged 1–13 and other related services. These Rules lay down the main requirements for internal procedures of the Edutainment Centre, the procedure for Visitor services and visiting the Edutainment Centre, and other requirements related to the activities of the Edutainment Centre in order to ensure coherent, safe and coordinated operation of the Edutainment Centre, good mood of each Visitor, and satisfaction with the Services provided by the Edutainment Centre. 3. If necessary, the Operator shall have the right to adopt individual instructions and/or regulations for Visitors to ensure proper internal procedures of the Edutainment Centre, including, but not limited to the safety procedures in emergencies. 4. Requirements of these Rules apply to all Visitors. Each Visitor of the Edutainment Centre agrees to comply with the requirements of these Rules. 5. The Operator shall have the right to amend or supplement these Rules, prices of Services, working time or, where necessary, to close the Edutainment Centre without prior notice. II. Working TIME, PRICE OF SERVICES, AND procedure for visiting the Edutainment Centre 1. The Operator shall set the working time of the Edutainment Centre, make a list of its activities and Services, and set their prices. The working time of the Edutainment Centre and the list of its Services and prices are provided at the registration desk of the Edutainment Centre and on the website www.curiocity.lt. 2. Activities and Services of the Edutainment Centre may be temporarily unavailable due to technical obstacles, when the maximum number of Visitors is reached and/or in other cases without prior notice. 3. The Services of the Edutainment Centre are intended for Children aged 1–13. Persons over 14 years of age shall not be admitted on their own without children to the Edutainment Centre. 4. Restrictions may apply to the age and physical condition of Visitors for certain activities and types of entertainment at the Edutainment Centre. They are specified at the Edutainment Centre where any such activities and types of entertainment take place. Visitors must comply with these restrictions. 5. Visitors can visit the Edutainment Centre after registration and making payment for the Services. 6. Children under the age of one year may visit the Edutainment Centre free of charge and must be accompanied by the person responsible for the Child, who has paid the fee set by the Edutainment Centre. 7. Children aged 1–4 may visit the Edutainment Centre only accompanied by the person responsible for the Child. 8. Children aged 4–5 may visit the Edutainment Centre on their own or accompanied by the person responsible for the Child, provided the additional fee set by the Operator is paid and the person responsible for the Child has signed his consent that the Child will visit the Edutainment Centre on his own, without the supervision of the person responsible for the Child. Children may visit the Edutainment Centre without the supervision of the person responsible for the Child and must wear special distinctive signs issued by the centre (bright vest, bracelet, etc.). 9. Children over 6 years of age may visit the Edutainment Centre on their own, provided the person responsible for the Child has signed his consent that the Child will visit the Edutainment Centre on his own, without the supervision of the person responsible for the Child. 10. Children with special needs, e.g. disabled Children or Children with other health issues may visit the Edutainment Centre only accompanied by a full-aged person (a person responsible for the Child). 11. The following personal information must be provided to the Employee of the Centre at registration: first name, surname and date of birth of the Child; first name, surname and contact details (phone number) of the person responsible for the Child. 12. During registration, the person responsible for the Child shall sign his consent and shall confirm that he has read these Rules and agrees to obey them and that he has familiarised the Child with the Rules and agrees to ensure that the Child will obey the Rules (hereinafter – Consent). 13. During registration, the Consent must be signed only by one full-aged person (a person responsible for the Child) who accompanies the Child/Children. All Visitors who are admitted to the Edutainment Centre confirm that they have read these Rules and agree to obey them unconditionally. If a Visitor is a minor, his parents/other legal representatives/full-aged persons accompanying the Child and authorised by parents (legal representatives) of the Child must familiarise the Child with these Rules and ensure that the minors will obey them. 14. During a visit to the Edutainment Centre, Children must wear the bracelets or smart watches or other distinctive admission signs issued by the Operator at all times and must not remove them themselves, but must protect them and treat them with care and return them to the Employees of the Centre at deregistration from the Edutainment Centre. A charge is applied for the lost admission sign. 15. In case of any doubt about the Visitor’s age, the Employee of the Centre shall have the right to require that the Visitor would provide his personal identity document (birth certificate, passport, personal identity card, student certificate, etc.). 16. The person responsible for the Child, prior to leaving the Child at the Edutainment Centre, must ensure that the Child’s health condition allows him to be on his own at the Edutainment Centre and play with other Children. The person responsible for the child leaving the Child at the Edutainment Centre must be cautious and diligent, and carefully evaluate the Child’s psychological and physical condition. 17. For the sake of health and safety of Visitors, Children and other persons ill with infectious, viral or other communicable diseases, with open wounds or other health disorders which pose danger to their own health and the health or life of other persons, are prohibited from visiting the Edutainment Centre. In case of any obvious doubt about the Child’s or another person’s health, the Employees of the Centre shall have the right to deny their access to the Edutainment Centre. 18. The time spent by a Visitor at the Edutainment Centre is recorded from the moment the Visitor passes the entrance gates to the Edutainment Centre after making payment for the Services. 19. Visitors/persons responsible for the Child must monitor their time spent at the Edutainment Centre. Visitors must pay the price set by the Operator for the additional time spent at the Edutainment Centre (for which they have not paid before entering the Edutainment Centre). This additional payment must be made at the cash desk of the Edutainment Centre before leaving (deregistration from) the Edutainment Centre. 20. There is a 15-minute window for deregistration; time in excess of this 15-minute window is charged as one hour. 21. The Child is registered to and deregistered from the Edutainment Centre only in the presence of the person responsible for the Child or, if a Child is visiting the Edutainment Centre on his own, only if the person responsible for the Child has come to collect the Child. Children are not deregistered from the Edutainment Centre on their own. 22. No refunds are available if a Visitor deregisters from 1. Unless the context requires otherwise, the words and phrases in these Rules, when capitalised, shall have the following meanings: the Edutainment Centre earlier, i.e. before the expiry of the time for which he has paid, or if the Visitor is expelled from the Edutainment Centre due to failure to obey these Rules. 23. Visitors must deregister at least 10 minutes prior to the closing time of the Edutainment Centre. III. RULES FOR ORDER, CLEANLINESS AND GENERAL BEHAVIOUR 1. A video surveillance system is available at the Edutainment Centre for security purposes. 2. A Visitor to the Edutainment Centre using its Services must strictly comply with the requirements and recommendations laid down in these Rules and obey instructions of the Employees of the Centre concerning safety requirements at the Edutainment Centre and compliance with these Rules; the person responsible for the Child is responsible for the supervision of the Child and for compliance with these Rules of the Edutainment Centre and must assume all risks and liability arising thereof. 3. Clothing, footwear, backpacks, hurdle bags, large and/or shopping bags, and prams or push chairs must be left in the cloakroom of the Edutainment Centre. Lockers provided for Visitors in the cloakroom are locked by the Visitors themselves, therefore the Operator recommends to make sure your locker is locked. If any personal items are lost, the Visitor must contact the Employee of the Centre immediately. The Operator is not responsible for any lost items. 4. Children must wear proper indoor footwear, which must be clean and safe and must not be slippery or must wear clean socks. Adult Visitors must wear disposable footwear slipped over their shoes or wear clean indoor footwear, which must be clean (or must wear socks if they wish to be without shoes). It is recommended for the Children to wear comfortable clothing suitable for playing games, without any cords, scarves or necklaces, which may become entangled in the equipment. 5. If there is any suspicion of the content of Visitors’ bags, the Employees of the Centre shall have the right to inspect the content of the bags brought to the Edutainment Centre. 6. For the sake of health and hygiene requirements, Visitors to the Edutainment Centre must be clean and tidy. 7. The Employees of the Centre shall have the right to decline admission to the Edutainment Centre if: 7.1 A person does not accept or does not understand the Rules; 7.2 A person’s behaviour could disturb the procedures of the Edutainment Centre or pose risk to health and safety of Visitors, hygiene of the Edutainment Centre or property of the Edutainment Centre and/or would be contrary to the norms of behaviour acceptable in the society; 7.3 A person would be under the influence of alcohol, narcotic, psychotropic or other substances. 8. Visitors must put all inventory and clothing for games, and other items back to where they belong. 9. If only one Visitor can use some inventory or equipment for the game at one single time, after it has been used, other Visitors must be allowed to use it. If the first Visitor wishes to use the inventory or equipment again, he shall wait for his turn. 10. The Employee of the Edutainment Centre must be contacted, if a Visitor needs help, has any problem or question, if any inventory or equipment does not operate, or if anyone gets hurt. 11. The following is prohibited at the Edutainment Centre: 11.1 To bring food and/or beverages; 11.2 To bring animals; 11.3 To smoke, bring and consume alcoholic beverages, narcotic, psychotropic or other prohibited substances; 11.4 To bring weapons, sharp, explosive, radioactive, breakable and/or other hazardous items and substances, which may cause injury to the person himself or other persons, may cause infection, spread pungent odour, and damage the property/valuables/inventory of the Edutainment Centre; 11.5 To damage, throw, break or otherwise vandalise the property/valuables/inventory of the Edutainment Centre; 11.6 To shout, run, push, climb and jump in other than the designated places; 11.7 To fight, misbehave, bully, use foul language, insult and otherwise interfere with other playing Children; 11.8 To litter, soil or otherwise disturb activities of the Edutainment Centre and interfere with other Visitors, to perform other unlawful actions or actions contrary to good morals and public order; 11.9 To take any property/valuables/inventory of the Edutainment Centre. In the case of any theft, the Employees of the Centre will always notify the police; 11.10 To sell, offer to buy or advertise to other Visitors any goods, items and/or services. 12. Visitors can eat and drink only in the café area of the Edutainment Centre, rooms for birthdays/events, and in the cookery class (and only the food and drinks purchased at the café of the Edutainment Centre). 13. It is allowed to take photographs, make films, and make video and audio recording for personal use of Visitors; it is prohibited to do this for commercial purposes and it is prohibited to record, take photographs and film other Visitors. IV. EMERGENCY PROCEDURES 1. All premises of the Edutainment Centre are equipped with the fire alarm system, automatic fire extinguishing system, perimeter security alarm system and an audio system which transmits audio notifications, i.e. messages informing Visitors and/or other third parties what to do if they are at the Edutainment Centre or outside the area of the Centre in the event of an accident or another emergency. 2. In the event of an emergency at the Edutainment Centre, e.g. in the event of a fire or explosion, natural disaster or catastrophe, sabotage or an act of terror, Visitors must carry out instructions given by the Employees of the Centre, the police, fire rescue and other services. 3. If a Visitor notices the source of fire or smoke, he must notify the Employees of the Centre immediately about it. 4. If any unattended items, explosives, chemical or radioactive materials are detected or reported, the Employees of the Centre must be notified about it immediately. Visitors must refrain from taking any localisation and decontamination actions themselves. 5. If there is any suspicion of abuse against any Child of the Edutainment Centre, the Operator shall have the right to report it to law enforcement authorities. 6. The Operator shall have the right to close the Edutainment Centre (or part thereof) with immediate effect and without any prior notice, if there is any security threat to the Edutainment Centre or its Visitors. 7. By signing this Consent the parent/other legal representative of the child or an authorised full-aged (adult) person accompanying the child and acting on behalf of the parents/other legal representatives of the child agrees that, in the event of an accident or other emergency, sabotage or a terrorist attack at the Edutainment Centre or outside its area where the evacuation of visitors from the Edutainment Centre is necessary, the Operator would take the child from the Edutainment Centre to a safe Meeting Point in the zone outside the Mega Leisure and Entertainment Centre marked in red in the plan below without the separate consent of the representative of the child in order to protect the health and life of the visitors of the Edutainment Centre, where this is possible. The representative of the child has been informed and is aware that following the evacuation of the child in the event of an emergency or where there is danger to the child’s health or life, the Operator will try to protect the child and take decisions which are the best in the situation to protect the child’s health and vital interests. V. FINAL PROVISIONS 1. The Edutainment Centre shall have the right to take photographs, make films and make various video and audio recordings on a regular basis on the premises of the Edutainment Centre without any separate notification of the Visitors and use any such photographs, films, and video and audio recordings for marketing purposes of the Edutainment Centre. Visitors admitted to the Edutainment Centre automatically give their consent that the photographs, films, and video and audio recordings of the Children they represent will be used for publicity purposes of the Edutainment Centre in social media and other media channels. The visitors have the right to contact the Edutainment Centre and request removal of the image of the Visitor and/or Child from the communication material. 2. The Operator is not liable for the Visitors’ personal items or for their loss and/or damage. Visitors are responsible for the security of their own personal items. 3. Any items lost at the Edutainment Centre and subsequently found and handed over to the Employees of the Centre shall be stored in the Edutainment Centre at the Operator’s discretion or shall handed over to the police in the manner prescribed by legal acts of the Republic of Lithuania. 4. The Operator shall not be liable for any loss, harm, injury or threat incurred by a Visitor and damage to his property, health or life, if the Visitor has failed to comply with these Rules or has breached the Rules. 5. If a Visitor causes damage to the Edutainment Centre and its inventory or damage to the property and/or health of other Visitors or other third parties, s/he shall be liable as prescribed by legal acts of the Republic of Lithuania. If damage is caused by a minor, his parents/legal representatives shall be liable for the damage. 6. Parents/legal representatives of minors or other full-aged persons accompanying the minors and authorised by parents (legal representatives) of the minors are responsible for familiarising them with these Rules and compliance with these Rules. 7. The Operator shall not examine any Visitor’s claims and shall not be liable for any property and/or moral damage incurred by the Visitor at the Edutainment Centre, if the Visitor has failed to comply with the requirements and/or recommendations in these Rules.
